Terms of Use
These Terms of Use (“Terms”) set forth the conditions for using “MIIDERA EXPERIENCE” (“Service”), which is operated by Miidera Temple, the Head Temple (“the Temple/we/us/our”).
Users agree to these Terms before using the Service.
1. Applicability of the Terms
- These Terms apply to all relationships between the Temple and users in connection with the use of the Service
- In addition to these Terms, the Temple may establish guidelines, rules, or notices posted on this website (hereinafter referred to as “Individual Provisions”). Such Individual Provisions shall form a part of these Terms. In the event of any inconsistency between these Terms and the Individual Provisions, the Individual Provisions shall prevail.
2. Description of the Service
- The Service enables users to submit applications for experience reservations (including inquiries) through this website, and for such reservations to be confirmed upon acceptance by the Temple or the relevant experience provider.
- Submission of a form on this website does not constitute a confirmed reservation.
3. Formation of Reservations
- A reservation shall be deemed confirmed at the time the Temple or the relevant experience provider accepts the application and notifies the user of such acceptance by email or other means.
- Even if the user fails to receive the acceptance notice due to communication issues, incorrect email addresses, or other reasons not attributable to the Temple, such failure shall not affect the formation of the reservation.
4. Fees and Payment
- Experience fees, content details, and duration shall be as set forth on the respective experience pages or related notices.
- Payment shall, in principle, be made in person at the experience location on the day of the experience. Online payments are not accepted.
- In the event that experience fees are revised, the fees applicable at the time the reservation is confirmed shall generally apply. However, revised fees may apply if the reservation details are subsequently changed.
5. Changes to Reservations and Cancellations
- Any changes to or cancellation of a reservation must be made using the methods designated by the Temple, such as the inquiry form on this website.
- Conditions for cancellation, including deadlines and whether cancellation fees apply, shall be governed by the separately established Cancellation Policy.
- If a user fails to attend the experience on the scheduled date without prior notice, the Temple may take measures such as suspending the user’s future use of the Service.
- If the Temple suffers damage as a result of the user’s failure to complete the required cancellation procedures, the user shall be responsible for compensating such damage.
- A cancellation shall be deemed completed at the time the user receives a “Reservation Cancellation Completed” email from the Temple.
6. Prohibited Conduct
Users shall not engage in any of the following acts:
- Submitting applications or registrations containing false information
- Interfering with the operation of the Service
- Unauthorized or improper use of email addresses or other contact information
- Use of the Service for commercial purposes, including resale or redistribution
- Acts that cause inconvenience, disadvantage, or damage to other users or the Temple
- Acts that violate laws or regulations, or public order and morals
- Any other acts deemed inappropriate by the Temple in a reasonable manner
7. Suspension or Restriction of Use
If a user violates these Terms, or if the Temple otherwise deems it necessary, the Temple may suspend or restrict the user’s access to all or part of the Service without prior notice.
8. Changes to or Suspension of the Service
- The Temple may change or suspend the content of experiences, dates and times of provision, methods of provision, or other aspects of the Service without prior notice due to unavoidable circumstances.
- Even if such changes to the Service result in inconvenience or damage to users, the Temple shall not be liable for any resulting damages.
- In the event that a user suffers damage due to reasons attributable to the Temple, the Temple’s liability for damages shall be limited to the total amount of usage fees actually paid by the user to the Temple during the one-month period preceding the occurrence of the damage, with respect to the relevant Service. However, this limitation shall not apply in cases of the Temple’s willful misconduct or gross negligence.
9. Disclaimer
- The Temple makes no warranty as to the accuracy or completeness of the information provided on this website.
- The Temple shall not be liable for any damages arising from causes not attributable to the Temple, including but not limited to natural disasters, communication failures, system maintenance, or unauthorized alterations by third parties.
- Any disputes arising between users, or between a user and a third party, shall be resolved at the user’s own responsibility and expense.
10. Handling of Personal Information
The Temple shall appropriately handle personal information obtained in connection with the Service in accordance with the Temple’s Privacy Policy.
11. Intellectual Property Rights
All rights to the content on this website, including text, images, and other materials, belong to the Temple or to legitimate rights holders. Users may not reproduce, redistribute, modify, or otherwise use such content without prior permission.
12. Amendments to the Terms
The Temple may revise these Terms as necessary. Continued use of the Service after such revisions shall constitute the user’s agreement to the amended Terms.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the Kyoto District Court or the Kyoto Summary Court as the court of first instance.
